Terms of Service
What PointsRadar does, what it deliberately does not do, and what each of us can expect of the other. Written for this service specifically rather than lifted from a template.
These terms are the agreement between you and PointsRadar when you use this website or the PointsRadar iPhone app. They are written to be read, not to be skipped — everything below describes how the service actually behaves.
Who you are agreeing with
PointsRadar is operated by James Arscott. Contact: info@pointsradar.co.uk.
What the service is
PointsRadar records which Virgin Atlantic reward flights have been available at which points prices, and tells you when a flight you are watching changes. It is an observation of a third party's availability, collected automatically a small number of times each day.
That has consequences worth stating plainly:
- The data is a snapshot, not a live feed. Between one collection and the next, a seat can appear, be taken, or change price without us knowing.
- A price you see here may no longer exist. Reward availability is controlled entirely by the airline and changes continuously.
- We do not guarantee accuracy or completeness. We may miss flights, record one incorrectly, or fail to collect at all.
- Only Virgin Atlantic can sell you a seat. Always confirm on their site or by phone before making plans. Nothing here is an offer.
Your account
Searching, browsing destinations and reading the guides need no account. Setting alerts does, because an alert is an email and we need somewhere to send it.
- Give accurate details and keep your password to yourself. You are responsible for what happens under your account.
- One account per person. Accounts are personal and not transferable.
- You must be 16 or over to create one.
- Tell us promptly if you think someone else has access to it.
Alerts are best-effort
We check your alerts after each data collection and email you when something matches. We do not promise that an email arrives, that it arrives quickly, or that a seat is still there when it does. Email can be delayed, filtered or rejected by your provider, and the seat that triggered the alert may be gone within minutes.
Do not rely on an alert as your only means of finding a flight, and please do not treat a missed or late alert as a loss we can make good.
Features and limits can change
PointsRadar is provided free. We add, change, restrict and remove features as the service develops, and different accounts may have different limits — for example on how many alerts you can set at once.
Where a change would reduce what your account can do, we will tell you before it takes effect, and wherever it is practical to do so we will let existing accounts keep what they already have rather than taking it away.
Using it fairly
The flight data here takes real time and money to collect, and it is the service. Please do not:
- collect, copy or extract the data by automated means — scraping, crawling, bulk downloading, or anything else that is not a person using the site;
- republish, resell or redistribute the data, or build a competing service from it;
- work around any limit on your account, including by creating extra accounts;
- attempt to interfere with the service, its security, or anyone else's use of it;
- use it unlawfully, or in a way that damages our relationship with the airline whose availability we observe.
We may rate-limit, suspend or close an account that does any of these, and we may do so without notice where the service is being harmed.
What belongs to whom
The site, the app, the design, the written guides and our compilation of the flight data belong to us. You may use them for your own personal, non-commercial purposes and nothing more.
Virgin Atlantic, Flying Club and related names and marks belong to Virgin Atlantic Airways Limited. We use them only to describe the flights the service observes.
Availability
We do not promise the service will be available, uninterrupted or error-free. We may suspend it for maintenance, change how it works, or withdraw it altogether. If we withdraw it permanently we will give reasonable notice where we can.
Our responsibility to you
We provide the service as it is. To the extent the law allows, we are not liable for money you did not save, a fare you did not get, a booking you did not make, or any loss arising from the data being wrong, late or missing.
Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. If you use PointsRadar as a consumer, your statutory rights are unaffected by anything in these terms.
Ending it
You can delete your account at any time in account settings, or by emailing us. Deletion is immediate and permanent — see the privacy policy for exactly what is removed.
We may close or suspend an account that breaches these terms. Where we reasonably can, we will tell you why first.
Changes to these terms
We will update this page when they change, and the date at the top with it. Where a change materially affects you, we will tell you by email before it takes effect. Continuing to use the service after that means you accept the new terms.
Law and disputes
These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the UK, you may bring proceedings in your own courts, and you keep the benefit of any mandatory protections of your local law.
If something is wrong, please email info@pointsradar.co.uk first — most things are fixable without any of the above.
